Last week Gambling911.com reported exclusively on two individuals being sued out of Georgia under a unique quirk in that state's law allowing for recovery of losses after a set period of time. Even the attorney representing the plaintiff in this matter tells us the law is "unique" to Georgia.
The law reads as follows:
"Gambling contracts are void, and all evidence of debt, except negotiable instruments in the hands of holders in due course or encumbrances or liens on property, executed upon a gambling consideration, are void in the hands of any person.
"Money paid upon a property delivered upon gambling consideration may be recovered by the loser by the institution of an action for the same within six months after the loss and, after the expiration of that time, by institution of an action by any person, or any time within four years, for the joint use of himself and the education fund of the county."
It's obvious the law is a bit outdated as to assume only males take part in this activity ("himself").
The plaintiff in question Edward B. Short of Georgia.
The attorney representing Mr. Short, Joe Durham of Albany, Georgia, assures us that his client is not some deadbeat looking to recoup losses as perhaps he fell on hard times. Durham and others familiar with the bookmaking business in question were quick to suggest via Twitter that at least one of the defendants, to put it nicely, does not always act in good faith.
Durham has since confirmed that Mr. Short is not an actual bettor but a whistleblower "to recover every dollar these guys took in".
Though this court filing is on public record, for the time being Gambling911.com has opted not to publish the names of either defendant.
Durham's efforts to go after deadbeat bookies has been met with praise by some of the most well known sports bettors including the world famous "Chinese Mike".
The lead defendant (bookmaker) is from a prominent family west of Birmingham, Alabama who also runs an auto dealership.
The other defendant is, well, hopefully reformed and has found God.....Maybe.
JP (his initials) was once shot and nearly died after allegedly breaking into a home along with another individual. A third man waited outside in a getaway vehicle. We can't say what his intentions were as the home's owner shot JP multiple times and couldn't really speak other than to beg for assistance. He was injured so bad, the future bookie had to be airlifted to a hospital that specializes in this sort of thing.
A neighbor at the time said he heard the gun shots and rushed over to find JP in pain. "I heard somebody screaming, he said help me sir help me."
The neighbor stayed with the home owner until emergency workers arrived. He said he knew JP was not going anywhere.
"He was laying on his butt and crying," the neighbor said.
Officers said at the time the 3 suspects, JP included, were unarmed and they had no idea why the trio had attempted to break into his home. There was a previous attempt to break in days earlier.
The officer did say "All I can go on is by what the driver of the Mercedes is telling us, that it was a burglary."
