FARGO, N.D (Gambling911.com) - Two Fargo, North Dakota brothers have been charged with felony robbery of a private poker game last month, holding six men at gunpoint.
Jackson James Dubois, 22, of Fargo, and Delton Robledo Dubois, 20, of West Fargo, were each charged August 28 in Cass County District Court with robbery involving a firearm, dangerous weapon, or destructive device, a Class B felony. Both were arrested August 31 and remain on the Cass County Jail roster.
According to a police charging document, three men wearing dark clothing and ski masks entered a building on Northern Pacific Avenue on August 28, during an invite-only poker game.
One of the six men held at gunpoint told police the weapon was placed against the back of his head. The group was ordered to the ground and robbed of their wallets, cell phones, and cash from the table, totaling an estimated $2,500.
Investigators identified a suspect vehicle, a black pickup truck with distinctive chrome trim, using nearby private security and traffic camera footage. The truck was linked to Delton Dubois.
Witnesses also implicated a former poker dealer who had been fired for intoxication. They claimed the individual had brought one of the brothers to a prior game. Investigators found text messages between one of the brothers and the former dealer discussing “making money” days before the robbery, along with additional messages allegedly discussing the plan.
Charging documents show that two stolen cell phones were recovered near an address connected to Jackson Dubois’ ex-girlfriend.
Cell phone location data reportedly placed Jackson in the area of the robbery at the time it occurred. Various items were recovered from a truck belonging to Delton Dubois including ski masks, dark clothing, gloves, an empty trash bag, and a bank deposit receipt, according to the charging document.
In addition to the former dealer, another individual questioned by authorities said he was aware of the robbery plan but got "cold feet" and did not participate.
Under N.D. Century Code § 12.1-28-02, gambling on private premises becomes an infraction when an individual player's total wager exceeds $25 per hand, game or event. If the amount exceeds $500 per hand, game or event, the offense rises to a Class A misdemeanor.
There is a more serious issue for the organizer. North Dakota makes it a Class C felony to engage in the “business of gambling.”
Friends playing a relatively low-stakes poker game at someone's home isn't necessarily illegal. But a regularly operated private poker room involving substantial wagers, a house rake, entry charges/profit for the organizer, or someone effectively operating a gambling business could present a much more serious legal problem.
The stakes of these games were not immediately known and the victims names have not been released.
In an ironic twist, Delton Dubois was featured in a High School senior spotlight just two years ago from the Dilworth-Glyndon-Felton School District (Independent School District 2164) in neighboring Minnesota.
"I have the pleasure of teaching you in World History, Government and Criminal Justice," the teacher wrote, identified as Mr. Rieder. "You have a very calm demeanor and great interpersonal skills.
Jackson James Dubois and Delton Robledo Dubois remain in custody at the Cass County Jail. Both were booked Aug. 31 with Jackson James Dubois charged with robbery involving a firearm, dangerous weapon or destructive device, a Class B felony.
Delton Robledo Dubois, 20, is charged with the same Class B felony charge.
