Is Underdog Fantasy Legal in New York State?
Underdog Fantasy is a new type of Daily Fantasy Sports (DFS) site that more closely resembles real money sports betting. Unlike with traditional fantasy sites where you go up against other players, here you are challenging the house. In this sense, the Underdog Fantasy website resembles that of a sportsbook parlay and/or player propositions found on websites like BetUS.
Underdog Fantasy is legal in forty-one states, including New York State.
Pick 'Em is a game offered on Underdog Fantasy that involves player stat predictions with a 2-5 leg entry, again similar to a parlay. As noted above, the choice of “Higher” or “Lower” is entered for each selected leg. Get four of five correct, you lose. Just like with a parlay, you'll need to get all five submissions correct to win that top prize. Additionally, Underdog Fantasy offers traditional contests.
Established competitors FanDuel and DraftKings have challenged Underdog Fantasy for offering what they claim to be something akin to sports gambling.
"Underdog and other companies innovating in fantasy sports and sports betting threaten their monopoly,” wrote Underdog Fantasy founder Jeremy Levine in a letter to Underdog clients. “They’ve seen our company, and others, produce superior products, more exciting user experiences, and begin to challenge them for sports fans’ attention — and they’re scared that we will challenge their market positions. We’re already bigger than they are in fantasy. Frankly, they should be scared.”
The New York Gaming Commission has sought to prohibit pick'em style games in the state's existing DFS rules.
