South Carolina Attorney Seeks Monetary Recovery From Polymarket, DraftKings

OAKLAND PARK, Fla (Gambling911.com) - A South Carolina attorney is suing both Polymarket and DraftKings, claiming the sites offer sports betting to South Carolinians under the guise of selling event contracts.

James M. Hughes is seeking a monetary recovery, not merely an order stopping Polymarket and DraftKings Predictions from operating in South Carolina.

Hughes, an attorney associated with Motley Rice in Mount Pleasant, filed the Charleston County action under South Carolina Code § 32-1-10, an old gambling-loss recovery statute.

“Any recovery from the suit is split between the plaintiff and the counties where illegal bets were placed.”

Hughes is not claiming he personally lost money with either company. He's invoking a South Carolina statute that allows an individual within the state to pursue recovery of qualifying allegedly illegal gambling losses. The defendants include Polymarket-related entities, DraftKings Predictions and various exchanges, clearinghouses and market makers.

South Carolina is among those U.S. states that do not regulate sports betting.  The activity has not been legal in the state since 1912.
